Terms & Conditions

These Terms govern your use of Evolve, an AI product intelligence platform operated by Evolve AI ("Evolve AI", "we", "us"). By creating an account or continuing to use the service you agree to these Terms and form a contract with Evolve AI. If you are using Evolve on behalf of an organisation, you confirm you have authority to bind it; otherwise you confirm you are of legal age to contract.

1. The service

Evolve lets you describe problems, run AI research and analysis, generate concepts, images and visualisations, build idea projects, and find and contact potential manufacturers or builders. Paid plans unlock higher usage allowances and additional tools.

2. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account.

3. Acceptable use

You must not misuse Evolve. In particular you must not:

• use the service unlawfully or for fraud, spam or deceptive purposes;
• infringe intellectual property, privacy or other rights of anyone;
• interfere with security — including malware, probing, penetration testing without consent, scraping, or circumventing rate limits or technical restrictions;
• reverse engineer, resell or redistribute the service; or
• generate illegal content, deepfakes of real people, hate speech, harassment, sexual content involving minors, malware, or content designed to jailbreak or subvert our AI safeguards.

4. AI outputs, inputs and accuracy

• You are responsible for your prompts, for how you use outputs, for verifying accuracy before relying on them, and for holding the rights to any content you input.
• As between you and us, you retain rights in your inputs and, to the extent permitted by law, we assign to you our rights in outputs generated for you. You grant us a limited licence to host and process your content solely to operate and improve the service.
• AI outputs, market research, evidence labels, opportunity scores and manufacturer suggestions may be inaccurate, incomplete or out of date. They are informational only and are not financial, investment, legal, tax, medical or other regulated professional advice. Decisions you take are your own responsibility.
• We may moderate content: we can remove or restrict content, refuse or filter outputs, and suspend accounts. Rights-holders can request takedown by emailing legal@buildwithevolve.org; repeat infringers will have their accounts terminated.

5. Intellectual property

Evolve AI retains all ownership of the service, including its software, models, documentation, design and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within the plan you have selected.

6. Service level

We work to keep Evolve available and reliable, but the service is provided "as is" and we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, renewal, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically each billing period until cancelled; cancelling stops future renewals and access continues until the end of the paid period. See our Refund Policy.

8. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using Evolve and delete your account at any time. On termination your licence ends; you can export your projects for 30 days, after which data may be deleted.

9. Liability

To the fullest extent permitted by law, we exclude liability for indirect, consequential or special damages, including loss of profits, data, business or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

10. Indemnity

You indemnify Evolve AI against claims arising from your content, your unlawful or infringing use of the service, or your breach of these Terms.

11. General

You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond reasonable control. We may update these Terms and will post the new version here with a revised date; continued use means acceptance. These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without affecting mandatory consumer rights in your country of residence.
